Who these terms are between
This website is operated by Michael Bloemeke, a professional magician based in North Carolina, performing as The Award-Winning Magic of Michael Bloemeke. Throughout these terms, "Michael" means Michael Bloemeke and "you" means the person using this site or booking a performance.
By using this website, you agree to these terms. If you do not agree with them, please do not use the site.
The signed agreement comes first
Every confirmed booking is covered by a separate Performance Services Agreement, which you read and sign before the booking is confirmed. That agreement is the document that governs your event, including the scope of the performance, the fee, and the cancellation terms.
If anything on this page ever appears to conflict with the agreement you signed, the signed agreement controls. Nothing on this page changes, replaces, or adds to it.
Enquiries, quotes, and booking
Submitting the contact form is an enquiry, not a booking, and it does not hold your date. Nothing on this website is an offer to perform, and prices shown or discussed are estimates until Michael confirms them in writing.
A date is reserved only once the agreement is signed and the booking fee has been received in full, as set out in that agreement. Until both of those happen, the date remains available to other clients.
Michael may decline any booking at his discretion.
Payment
Fees, deposits, and due dates are set out in your agreement and on your invoice. Invoices are issued through QuickBooks, and online card payments through QuickBooks may carry a processing fee charged by the payment provider rather than by Michael. If you would prefer to avoid that fee, other payment methods are usually available. Just ask.
Your event details
When you complete the booking form, you are confirming that the event details you provide are accurate. Michael plans and prepares around them, so please tell him as early as possible if anything changes, particularly the date, the time, the venue, or the number of guests. Some changes can be accommodated and some cannot, depending on timing and availability.
This website
Michael tries to keep this site accurate and current, but it is provided as-is. Photographs, videos, descriptions, and reviews shown here illustrate past work and are not a promise that any particular routine, effect, or outcome will feature in your event.
The text, photographs, video, logos, and design on this site belong to Michael or to the people who created them, and may not be copied or reused without permission. Client logos and reviews shown on this site remain the property of their respective owners and are used to identify past work.
This site links to other websites, such as social media and video platforms. Michael is not responsible for the content or the privacy practices of sites he does not operate.
Photography and recording
Whether Michael may photograph or record your event, and whether he may use that material to promote his work, is dealt with in your signed agreement. Some agreements include that permission and some deliberately do not, so refer to the version you signed.
Liability
To the fullest extent the law allows, Michael's total liability in connection with this website or a booking is limited to the amount you have actually paid him for that booking. Michael is not liable for indirect or consequential losses, such as lost profit or lost opportunity.
Nothing in these terms limits any liability that cannot legally be limited.
Privacy
How your information is collected and used is explained in the Privacy Policy, which forms part of these terms.
Governing law
These terms are governed by the laws of the State of North Carolina, and any dispute arising from them will be handled in the courts of North Carolina.
Changes to these terms
Michael may update these terms from time to time. The current version always lives on this page, and the date below shows when it last changed. Your signed agreement is not affected by later changes to this page.
